Personal Injury in Kansas: Statute of Limitations

Generally, Kansas has a two-year statute of limitations on making a claim for personal injury damages.  This period can stretch to five years if the claim arises from an uninsured motorist causing the injury.  An underinsured motorist claim can also sometimes have a five-year statute if the negligent driver’s policy has been offered prior to the two-year deadline. 

Minors can have up to eight years to get a claim filed on their behalf if they have been injured by someone else’s negligence.
